Tomaya Studio provides design and creative services, including but not limited to:

• Product and packaging design

• Brand strategy and visual identity

• CGI and visualisation

• Creative direction and production

• Sourcing and manufacturing support

Each project is defined individually through a proposal or agreement.

 
Payments
 
Our work is structured in stages, and so are our payments.

• A deposit is required to initiate new projects (non-refundable)

• The remaining balance is invoiced according to agreed milestones

• Standard payment terms are 10–30 days from invoice date

Late payments may incur additional fees and may impact timelines or delivery.

 
Project Flow
 
Design is a process.
Timelines are established at the outset, but may evolve in response to progress, feedback, or external factors.
We prioritise precision, clarity, and outcome over speed.
 
Non-Payment

In the event of delayed or incomplete payment:

• We reserve the right to pause ongoing work

• Final deliverables and usage rights may be withheld until full payment is received

Collaboration

Our work is collaborative by nature.

• Timely feedback and approvals are essential to maintain progress

• Delays in communication may affect timelines and outcomes

• We assume all materials provided by the client are approved for use
   

Intellectual Property

All work created by Tomaya Studio remains our intellectual property unless otherwise agreed in writing.

• Upon full payment, the client is granted usage rights as defined in the agreement

• Transfer of full ownership or exclusive rights must be explicitly stated

We reserve the right to present the work in our portfolio and communications, unless agreed otherwise.

Third-Party Assets

Any external assets (such as fonts, music, imagery, or software licenses):

• Are the responsibility of the client unless explicitly included

• May require additional licensing fees

Production & Manufacturing

When supporting sourcing or production:

• We act as creative and advisory partners

• Final responsibility for manufacturing, logistics, compliance, and distribution remains with the client

Liability

We take care in our process and recommendations.
However, Tomaya Studio is not liable for:

• Manufacturing outcomes or third-party performance

• Technical or operational issues outside our direct control

• Use of deliverables after project completion
   

Confidentiality

We treat all client information, materials, and processes as confidential, unless agreed otherwise.

Governing Law
